Test Drive Agreement - Terms & Conditions

I have requested that Westside Auto Wholesale permit me to test drive the aforementioned vehicle. I understand that the Dealership is permitting me to test drive the vehicle subject to the following terms and conditions:

1. I have a current and valid Australian driver’s licence or I have held a permanent visa granted under the Migration ACT 1958 for longer than 3 months and am permitted to operate the aforementioned vehicle.
   1. I have had my driver’s licence for more than 2 years (a learners permit does not apply)
2. I will returned the vehicle in the same condition as I received it.
3. I understand the aforementioned vehicle is NOT to be used or driven off-road.
4. Whilst I am in possession of the aforementioned vehicle,
   1. I will report any damage, accident, theft or vandalism involving the vehicle to the police and Westside Auto Wholesale.
   2. I will be responsible for all fines and infringements incurred on the vehicle, during the loan period.
5. Whilst I am in possession of the aforementioned vehicle, I will comply with all state legislation regarding the use of a motor vehicle.
   1. Under the WA State Government Hoon Legislation, if the aforementioned vehicle is impounded, seized or destroyed, I will be responsible for all costs incurred by and pertaining to the vehicle.
6. I understand that in the event of an accident and/or theft where I am not at fault NO insurance excess applies
7. I agree in the event of an accident and/or theft where I am fault a $2500 insurance excess applies if the driver is 25 years or older and I will be responsible for paying this amount in its entirety. If the driver is under 25 years of age an excess of $3500 will apply.
8. I agree to defend, indemnify and hold harmless the Dealership from and against and all losses, liabilities, damages, injuries, claims, demands, costs and expenses arising out of my use, possession and control of the vehicle and any breach of my responsibilities as set forth in this Agreement
9. If I am in breach of this Agreement or fail to return (if unaccompanied) the vehicle to Westside Auto Wholesale as required by this Agreement:
   1. I will be required to pay all expenses incurred by the Dealership to have the vehicle returned to the Dealership premises
   2. I authorise the Dealership, or any of its agents or employees to peacefully take possession of the vehicle
10. I understand the Dealership will not be liable for loss of or damage to any property that I may have left in the vehicle, either before or after its return to the Dealership

By signing this agreement, I acknowledge that the vehicle is the property of Westside Auto Wholesale and this agreement is solely for the purpose of allowing me to use the vehicle as permitted by the terms and conditions stated herein.

Loan Car Agreement - Terms & Conditions

Westside Auto Wholesale (Dealership) hereby undertake that the aforementioned vehicle is:

1. Suitably registered and fit for the purpose of the Loan
2. Insured for Third Party Property Damage
3. Mechanically sound and suitable for on road use only
4. In a roadworthy condition

I hereby understand that the Westside Auto Wholesale is Loaning me the aforementioned vehicle subject to the following terms and conditions while my vehicle is being repaired or serviced:

1. I hold a current and valid Australian driver’s licence or I have held a permanent visa granted under the Migration ACT 1958 for longer than 3 months and am permitted to operate the aforementioned vehicle.
   1. I have had my driver’s licence for more than 2 years (a learners permit does not apply)
   2. My personal details I have supplied are correct and I acknowledge that Westside Auto Wholesale relies on the truth of these representations.
   3. I give permission to Westside Auto Wholesale to contact me in relation to the loan.
      1. If Westside Auto Wholesale require the aforementioned vehicle returned for sales purposes, I will return the vehicle promptly and in the same condition in which it was received.
2. I understand that no person other than myself is authorised to drive the aforementioned vehicle without the written consent of Westside Auto Wholesale.
3. I have informed Westside Auto Wholesale that the loan car will be used for Business or Commercial use whilst in my possession, and understand I am NOT permitted to
   1. Use the vehicle for any other purpose in excess of that for which the vehicle was designed and constructed
   2. Carry volatile liquids, gases, explosive, corrosive or inflammable materials
4. I understand that under NO circumstances am I permitted to use the aforementioned vehicle for the purpose of ride sharing
5. Whilst I am in possession of the aforementioned vehicle, and in the event of an accident and/or theft,
   1. If the driver is 25 years or older, a maximum of $2,500 insurance excess applies and if the driver is under 25 years a maxium of $3,500 insurance excess applies and I will be responsible for paying this amount in its entirety.
   2. I accept full responsibility for any repairs for any other damage sustained during the possession or use of the vehicle where such damage is not covered by Westside Auto Wholesale’s insurance.
   3. I will report any damage, accident, theft or vandalism involving the vehicle to the police and Westside Auto Wholesale.
   4. I give permission for Westside Auto Wholesale to share my personal details to relative 3rd party businesses.
6. Whilst I am in possession of the aforementioned vehicle
   1. I will be responsible for all fines and infringements incurred on the vehicle, during the loan period.
   2. I will comply with all state legislation regarding the use of a motor vehicle.
      1. Under the WA State Government Hoon Legislation, if the aforementioned vehicle is impounded, seized or destroyed, I will be responsible for all costs incurred by and pertaining to the vehicle.
7. Whilst I am in possession of the aforementioned vehicle, I understand the following is NOT permitted
   1. Driving off-road
   2. Smoking or Vaping inside the vehicle
   3. Animals inside the vehicle
8. I understand that the repairer whom carries out the repairs to your vehicle will have the right to charge storage up to $30 per day to keep your vehicle onsite after you have been informed the repair has been completed, unless prearranged either by the business repairing your vehicle or Westside Auto Wholesale
   1. Also the aforementioned vehicle must be returned to Westside Auto Wholesale as soon as your vehicle’s repair has been completed and prior to collection of your vehicle
   2. Westside Auto reserves the rights to collect the loan vehicle at any time, depending on the reason for loaning a vehicle, another loan vehicle may be provided
9. I agree to the following if I am in breach of the Agreement
   1. I will defend, indemnify and hold harmless the Dealership from and against and all losses, liabilities, damages, injuries, claims, demands, costs and expenses arising out of my use, possession and control of the vehicle and any breach of my responsibilities as set forth in this Agreement
   2. Or fail to return the vehicle to Westside Auto Wholesale as required by this Agreement:
   3. I will be required to pay all expenses incurred by the Dealership to have the vehicle returned to the Dealership premises
   4. I authorise the Dealership, or any of its agents or employees to enter my premises peacefully to repossess the aforementioned vehicle as required and I will be responsible for any costs incurred.
      1. I understand the Dealership will not be liable for loss of or damage to any property that I may have left in the vehicle, either before or after its return to the Dealership
   5. I forfeit the right to the use of a loan vehicle from Westside Auto Wholesale in the future.
10. I have personally inspected the vehicle and found it free from any visible damage and/or defects, except as otherwise noted by the Dealership.
11. I will contact Westside Auto Wholesale as soon as possible if the aforementioned vehicle has any issues or alerts that require dealer attention.
12. When returning the aforementioned vehicle I agree to
    1. Returning the vehicle with no less fuel than indicated on the vehicle inspection
       1. Or I will be responsible for the cost to refuel the vehicle to the same as indicated on the inspection
    2. Returning the vehicle in the same condition in which it was received it
       1. Or I will be responsible for all costs incurred for repairs and detailing the vehicle.

*If Westside Auto Wholesale recovers such insurance excess successfully from a third party following a claim Westside Auto Wholesale agrees to reimburse the customer any monies held/taken from the customer as insurance access

By signing this agreement, I hereby take full responsibility for the aforementioned vehicle in accordance to the Terms and Conditions. I have read and understand these conditions and have received a copy of these prior to taking delivery of the vehicle. In the event of damage occurring to the vehicle whilst in my possession I authorise Westside Auto Wholesale or their servants or agents to charge me for any insurance excess where damage occurs and charges in accordance with this Agreement after they have been recorded
